Conditions

1. General
the following terms and conditions apply to all orders placed. They are deemed to have been agreed if they are not contradicted immediately.
"Photographs" within the meaning of these terms and conditions are all products manufactured by 1001Berlin , regardless of the form or medium in which they were created or are available. (Negatives, slides, paper images, style videos, electronic stills in digitized form, videos, etc.)

2. Copyright
1001Berlin owns the copyright to the images in accordance with copyright law.
The photographs produced by 1001Berlin are basically intended for the client's own use. The transfer of usage rights requires a special agreement. The rights of use are only transferred to the client after full payment to 1001Berlin .
The person ordering a picture within the meaning of § 60 UrhG has no right to reproduce and distribute the photograph if the corresponding rights of use have not been transferred.
When using the photographs, 1001Berlin can, unless otherwise agreed, demand to be named as the author of the photographs. A violation of the right to be named entitles 1001Berlin to compensation. The negatives will only be handed over to the client if a separate agreement has been made.
1001Berlin reserves the right to distribute profile and cover photos or music videos on its own website, unless otherwise contractually agreed. 


3. Remuneration, retention of title
A fee will be charged for the production of the photographs as an hourly rate, daily rate or an agreed flat rate. Ancillary costs (travel expenses, model fees, expenses, props and material costs, studio rentals, etc.) are to be borne by the client.
Invoices are payable within 14 days without deduction.
The supplied photographs remain the property of 1001Berlin.de until the purchase price has been paid in full
Without express instructions from the client regarding the design of the photographs, complaints regarding the image design and artistic-technical design are excluded.

4. Liability
- The photographer undertakes to carry out the order with the greatest possible care, in particular to treat the objects, templates, films, displays, layouts provided to him with care. He is only liable for damage incurred in the event of intent or gross negligence.
Unless otherwise agreed, the photographer is entitled to destroy third-party and own negatives after two years. He is only liable for damage and destruction of the negatives in the event of intent or gross negligence. The photographer is only liable for his vicarious agents in the event of intent or gross negligence.
The photographer is only liable for the light resistance and durability of the photographs within the framework of the guarantee provided by the manufacturer of the photographic material. He is not liable for damage caused by improper handling of the photographs by the customer.
Complaints about obvious defects must be made in writing to the photographer within two weeks of receipt of the photographs. 

5. Ancillary Obligations
The client ensures that he has the right to reproduce and process all templates handed over to the photographer and, in the case of portraits of people, the consent of the people depicted for publication, reproduction and processing. Claims for compensation by third parties based on the violation of this obligation shall be borne by the customer.
The photographer undertakes to treat all templates and objects made available to him with care, he is liable for intent.

6. Performance disruptions, cancellation fee

If the contractually agreed appointment is canceled or not kept by the customer, a cancellation fee of €90.00 will be charged from 3 months before the appointment. If the time provided for the execution of the order is significantly exceeded for reasons for which 1001Berlin is not responsible, the photographer's fee increases accordingly, provided that a flat rate was agreed. In the event of intent or negligence on the part of the client, the photographer can also assert claims for damages.
Delivery dates for photographs are only binding if they have been expressly confirmed by the photographer. The photographer is only liable for exceeding the deadline in the case of intent and gross negligence.
The photographer has the right to stop his work if other people also take pictures during the recording and do not refrain from doing so even after being asked to do so.

7. Privacy
Personal data of the customer required for business transactions can be stored. The photographer undertakes to treat all information that has become known as part of the order confidentially and not to pass it on to third parties, unless otherwise agreed.

 

8. Information on this website
Although we take the greatest care to check the information provided on this website for accuracy, errors and mistakes can occur. 1001Berlin.de is not liable for business interruption, loss of earnings or sales, loss of data or other direct or indirect damage arising from or in connection with any information presented on this website or the hyperlinks on this website.
 

9. Copyrights, trademarks, company logos
This website and all content is copyrighted and may not be copied or imitated, either in whole or in part. Neither the logo nor graphics or photos may be used without the express written permission of 1001Berlin.de  copied or reused from this website. All trademarks used on this website are registered or unregistered trademarks of 1001Berlin.de .
